Who we are.

On these pages "we" is Polarfon, the trade name of David Boot, a sole proprietorship registered with the Dutch Chamber of Commerce (KVK 42173551), and "you" is whoever uses this site or our software. The rest of who we are in law, our address included, is on the imprint. By using this site or its services you accept these terms. If you buy for a company, you accept them for it, and say you may.

Who sells to you.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders.

In plain words: you buy from Paddle. Paddle takes the payment, charges your country's tax (the price includes it), sends the receipt and pays back any refund, under Paddle's buyer terms. Questions about a payment go to Paddle, at paddle.net.

What you buy.

A license to use one of our instruments or effects, under the license: the right to use it, not the software itself. The software is a free download; the license is what you pay for, and it arrives by email, usually within a minute. The checkout shows the final price, with your country's tax, before you pay.

Each one has a demo with no time limit. Try it before you buy: it is the surest way to know that it runs on your computer and does what you want.

Refunds.

The refund policy says when a purchase is refunded and how to ask.

When we stop making something.

We may stop selling or developing an instrument or effect. A license you have keeps opening the versions it covers.

Your data.

What we keep about you, why and for how long is on the privacy page.

Ideas you send us.

We like hearing what you think. What you send us (an idea, a wish, a bug report) we may use freely, in an update or in something new, without owing you anything for it. Please don't send us anything you want to keep to yourself.

The services on this site.

My licenses sends your licenses again, Redeem turns a shop's code into a license, support answers your email and the newsletter writes when there is news. We run them with care, without a promise that each is there at every hour. Our software doesn't need them: once you have your license, it works offline, without us. We may change or end a service, and we may shut someone out of one who abuses it.

Using this site.

Read it, link to it, quote it. Don't try to break it, to reach what isn't yours, to copy it wholesale by machine, or to use its forms to send email to people who didn't ask. The words, the pictures, the design and the names Polarfon and Drum are ours; the names of other companies belong to them.

Our responsibility.

Nothing on this page takes away a right the law gives you as a consumer.

Beyond that, this site and its services are provided as they are. We are not liable for indirect loss, such as lost work, lost income or lost data. Where we are liable, it is for no more than what you paid for the license the claim is about. We are not liable for what we can't reasonably control, such as an outage at Paddle, at our host or in email, or another company's service. These limits do not apply to damage caused by our intent or gross negligence, or where the law does not allow a limit. If you buy or use our software as a business, the protections the law gives consumers don't apply to you, and these limits apply in full. Our instruments and effects, the demos included, are covered by the same limits in the license, which you accept when you install or use one.

If someone claims against us.

If you break these terms, the license or the law with our site or software, and someone holds us responsible for it, you cover what that costs us, as far as the law allows.

Changes.

We may change these terms; the date at the top says when they last changed. For a purchase, the terms of the day you bought apply.

Law and court.

These terms and the license are under Dutch law, the law where Polarfon is based. The purchase itself is between you and Paddle, under Paddle's buyer terms. A dispute with us goes to the court of Gelderland in the Netherlands, unless the law gives you, as a consumer, the right to go to the court where you live. A consumer also keeps the protection of the mandatory law of their own country.

If a part of these terms does not hold, the rest still does. If we don't act on a breach at once, we haven't given up the right to. We may transfer these terms and the license to whoever takes over our business. Where these terms are translated, the English text is the one that counts.
