This agreement.
This is the agreement between you and Polarfon (who we are in law: the imprint) for each of our instruments and effects. Installing or using one means you accept it. Below, "the software" is the instrument or effect a license is for.
The demo.
Without a license the software is a demo, with no time limit. Use it freely to try it. What waits for the license is said on its own page. You may pass an installer on to others, unchanged and free of charge.
Your license.
A license is a person's: it is licensed to you, by name, and you may use the software on every computer you own, on every system and in every format we release it for, for as long as you like. There is no account, no activation server, and nothing goes online.
A company, school or studio may buy a license for someone: it is licensed to the person who uses it, and is theirs.
There is no copy protection beyond your name on the license. So it is yours alone: don't share its code, and don't publish it.
What you make is yours.
The music you make with our software is yours, to release and to sell, with no fee and no credit owed. So are the sounds and presets you design yourself, from scratch.
What stays ours.
The software is licensed to you, not sold. It, its code, its sounds, presets and patterns, its design and its name stay ours. You may not rent or lend it, or sell it other than by transferring your license (below); sell or give away its sounds, presets or patterns as a library or a sample pack, as they are or lightly changed; take it apart to copy how it works, except where the law gives you that right; change it, or remove or get round its license check or its copyright notices; or use it, its sounds or its presets to train a machine-learning model.
Updates.
Every update within a major version is free. A new major version may be a paid upgrade; your license keeps opening the versions it was bought for.
License transfers.
You may transfer your license to someone else, with our help. Not in the first six weeks after it became yours. Until nine months after it became yours, for a fee of €10. After that, free. Write to us from the address the license was sent to, with the new owner's name and email address. The new owner gets a license in their own name and yours ends: you may no longer use it, and you remove it from your computers. We take no part in what the two of you agree. We may refuse to transfer a license that was refunded, charged back or obtained by fraud.
Press copies.
A license marked NFR (not for resale) is given, not sold. It works like any other, cannot be transferred, and we may withdraw it.
When a license ends.
If the payment for a license is refunded or charged back, that license ends: you may no longer use it, and My licenses no longer sends it. If a license was obtained by fraud, if its code is shared or published, or if this agreement is broken, we may withdraw it. A license that was charged back or withdrawn stops opening new releases of the software. A withdrawn license is not refunded. When a license ends, what stays ours, the limits below and the law and court still apply.
No warranty beyond the law's.
We make our software with care, test it hard and fix what we find. Still, it is provided as it is, without a promise that it is free of faults or fit for a particular purpose. A version may stop running on a later macOS or DAW; updates are how we keep up, for as long as we make them. Keep copies of your work.
Nothing here takes away a right the law gives you as a consumer. Beyond that, we are not liable for indirect loss, such as lost work, lost income or lost data; and where we are liable, it is for no more than what you paid for the license. These limits do not apply to damage caused by our intent or gross negligence, or where the law does not allow a limit. If you use the software as a business, the protections the law gives consumers don't apply to you, and these limits apply in full.
What it is built with.
Our software contains software and typefaces made by others, each under its own terms. They are listed, with their notices, in each installer. VST is a registered trademark of Steinberg Media Technologies GmbH.
Law and court.
This agreement is under Dutch law, the law where Polarfon is based. A dispute goes to the court of Gelderland in the Netherlands, unless the law gives you, as a consumer, the right to go to the court where you live. A consumer also keeps the protection of the mandatory law of their own country.
If a part of this agreement does not hold, the rest still does. If we don't act on a breach at once, we haven't given up the right to. Where this agreement is translated, the English text is the one that counts.
